1. Using SMSF Home
These Terms form an agreement between the user and SMSF HOME AUSTRALIA PTY LTD (ACN 701 721 977, ABN 31 701 721 977), the Australian company that operates and provides SMSF Home.
These Terms govern access to and use of SMSF Home. By creating an account or continuing to use the service, a user agrees to the current version presented through registration or an in-product notice.
2. The SMSF Home service
SMSF Home is an operating workspace for trustees to organise the enduring information, evidence, workflows and professional relationships around an SMSF. A trustee can use the trustee workspace without appointing a professional through SMSF Home.
Trustee-authorised professionals can request, review and return information through role-specific workspaces. The platform does not become the trustee, administrator, accountant, auditor, adviser, lawyer, broker, lender, tax agent or other professional.
3. Strong guidance, not platform advice
SMSF Home can explain general SMSF processes, organise records, identify missing information, surface dates and inconsistencies, guide preparation and show what a workflow requires next.
It does not choose investments, determine personal suitability, decide tax or legal treatment, certify audit sufficiency or declare a fund compliant. A prompt, status, extracted figure, classification or confidence score must be reviewed in its context. Advice or conclusions recorded by a professional remain that professional's work.
4. Tax and BAS service boundary
SMSF Home is not a registered tax or BAS agent. It can organise tax-related records, show source-based workflows and prepare information for review, but it does not provide tax or BAS advice for a user to rely on in meeting an obligation.
Where tax or BAS advice is required, users should obtain it from an appropriately registered tax or BAS agent. Any tax conclusion recorded by a trustee-authorised professional remains that professional's work.
5. Accounts and user authority
Users must provide accurate registration information, use their own account, protect credentials and act promptly if access may be compromised. A user must only create, upload, change, share or authorise information where they have authority.
Trustees remain responsible for fund decisions, records, appointments, lodgements, investments, tax, audit and compliance obligations. Users must review information before relying on it and obtain appropriately qualified or licensed advice where needed.
6. Documents and user content
Users retain their rights in content they provide and permit SMSF Home to host, process, copy, display and transmit it only as reasonably required to provide, secure, support and administer the service and authorised access pathways.
Users must not upload unlawful material, malicious code, another person's information without authority, or passwords, private keys, seed phrases or recovery codes. SMSF Home should not be the only copy of records a user is required to retain.
7. Professional access and document scopes
A saved contact, directory profile, enquiry or signup code does not appoint a professional or grant fund access. Authority is separate, fund-specific and permissioned. Trustees may narrow, suspend, expire or revoke it.
Trustee Fund Record documents and private professional working files are separate. Professionals remain responsible for their engagement, independence, confidentiality, licensing and professional obligations.
8. Professional Directory
Directory participation is optional. Profile information, credentials, availability and services are supplied by the professional unless an item is expressly marked independently verified.
A listing is not endorsement, recommendation, appointment or guarantee. Trustees must assess qualifications, licensing, independence, fees and engagement terms. Professionals must not use SMSF Home to browse, identify or solicit private funds.
9. Acceptable use
- Use the service only for lawful fund recordkeeping, workflow, oversight and authorised collaboration.
- Do not evade permissions, seek unauthorised access, probe another user's data, disrupt the service or introduce malicious material.
- Do not misrepresent identity, authority, credentials, source records or platform outputs.
- Do not exploit protected product material except where a right cannot lawfully be excluded.
10. Availability, changes and external services
SMSF Home may be maintained, updated, changed, interrupted or unavailable. It does not guarantee uninterrupted or error-free operation. External professionals, government bodies and financial institutions act independently; SMSF Home does not control their advice, decisions, fees or performance.
11. Fees
Any paid plan, price, billing interval, renewal, cancellation and refund terms must be shown before a charge is accepted. Better organised records may reduce avoidable professional preparation, but SMSF Home does not guarantee a fee reduction or financial outcome.
12. Suspension, closure and deletion
Access may be restricted where reasonably necessary to protect users or the service, respond to misuse, comply with law or give effect to account and authority changes.
Closure begins the recovery and deletion lifecycle shown to the user. Eligible records are deleted after the stated period, subject to legal holds and lawful retention. Recovery may not restore ended authorities or invitations.
13. Consumer rights and responsibility
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including applicable Australian Consumer Law rights.
Users remain responsible for decisions based on inaccurate, incomplete, stale, unreviewed or unauthorised information and for the independent acts of professionals and other external services.
14. Governing law, changes and contact
These Terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and courts hearing appeals from them.
Material changes affecting rights or obligations will be brought to affected users' attention and may require renewed acceptance. Questions can be raised through the SMSF Home support channel.
